Illinois employers must navigate a complex web of leave laws, including federal FMLA, state-specific leave, and local ordinances.

1. Paid Leave for All Workers Act
- Employees accrue one hour of paid leave for every 40 hours worked, up to five days per year.
- Leave can be used for any reason, and employers cannot require disclosure of the reason.
- Applies to nearly all employees, including part-time and temporary workers18.
2. Family and Medical Leave
- FMLA provides up to 12 weeks of unpaid, job-protected leave for eligible employees.
- Illinois’ FNICLA adds up to 10–20 days of unpaid leave for parents with a child in a NICU, in addition to FMLA leave241514.
3. Other Leave Laws
- Bereavement, military, jury duty, voting, and blood/organ donation leave.
- Domestic violence and victim leave (VESSA).
- Lactation accommodation (paid breaks effective 2026).
